UP ME has been developed for general awareness and educational purposes, with a view to encourage reduction and rationalisation of the recreational use of digital screen media in order to safeguard communities, particularly in India, from the multitude of health problems known to be associated with the excessive, indiscriminate and rising use of devices with digital screens. UP ME has been developed to serve communities, and therefore it's usage is free of any charge to the user and the owner or the supporter of development of UP ME do not have any commercial intent behind its development and do not derive any financial benefit from it.

 

1. Acceptance of Terms

 

By accessing and using the UP ME app (hereinafter also referred to as "the App"), you agree to comply with and be bound by the following terms of use, privacy policy, copyright clause and disclaimer ("Terms"). If you do not agree with these Terms, please refrain from using the App.

 

2. Privacy Policy

 

a. Personal Information: We may collect and store personal information in accordance with our Privacy Policy. By using the App, you consent to the collection and use of your personal information as outlined in our Privacy Policy.

 

b. Security: The App uses Laravel default security as provided by the developer WTD.

 

c. Health Information: The App includes features to provide health-related features, such as scanners for various health conditions. However, the app does not call for or require any health-related data from the users, yet users are advised to use full discretion when sharing any sensitive information.

 

d. External Links: The App may contain links to external websites. We are not responsible for the content or privacy practices of these third-party sites.

 

3. Copyright and Intellectual Property

 

a. Ownership: All content, including but not limited to the structure framework and presentation of the planners, user experience, UI, code, videos, graphics and logo of UP ME are the exclusive property of the App owner unless otherwise stated, and are protected by copyright laws and international treaties. Users of the App are granted a limited, non-exclusive, non-transferable licence to use the App solely for its intended purpose. Any use, reuse, copy, reproduction, distribution, modification, or creation of derivative works based on the App's content or any part thereof, without the express written permission from the owner, is strictly prohibited. Users acknowledge that the originality and innovative features of the App are a result of diligent research, innovation and simplified and practical application of evidence-based methods, making it a proprietary product of the owner of the app. In the event of any unauthorised use or infringement of the App's copyright, the owner of UP ME reserves the right to pursue legal remedies, including but not limited to injunctive relief and monetary damages, to protect its intellectual property rights. b. User-Generated Content: Admin users for individual languages may contribute content, such as formats for media use plans, screeners and healthy practice posters in the assigned language. By submitting content, such users grant the App owner a worldwide, royalty-free, non-exclusive licence to use, modify, and distribute the content. The plans created by other users are stored in the server database with the use of Laravel default security.

 

4. Subscription and Ads

 

a. Free Access: The App is currently free to use, but the owner reserves the right to introduce subscriptions or advertisements or any other features in the future if deemed necessary to sustain the App. Accordingly, some or all of the features freely available in the App at present, may be withdrawn or made subscription based or clubbed with advertisements anytime in the future.

 

5. Modification of Terms

 

The App owner reserves the right to modify these Terms at any time. Users are responsible for reviewing the Terms periodically, and continued use of the App constitutes acceptance of any changes.

 

6. App Modification and Discontinuation

 

The owner may, at their discretion, modify or discontinue the App at any time without prior notice. The owner holds no liability whatsoever for any consequences resulting from the discontinuation of the App, and in their own interest users are advised to arrange backup of the plans and other material (if any) generated by them, on their own native devices.

 

7. Disclaimer of Liability:

 

(i) No Warranty:

The UP ME app is provided "as is" without any warranties, expressed or implied. We make no representations or warranties in relation to this application or the information and materials provided.

 

(ii) Use at Your Own Risk:

Users acknowledge that the use of UP ME app is at their own risk. We shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with the use of this application.

 

(iii) No Responsibility for Content:

The UP ME application is intended for informational and educational purposes only. It does not provide personalised medical advice, diagnosis, or treatment. The content within this app should not be considered a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have used this application.
The author, developer, translators or other functionaries associated with creation and publication of this application do not assume any liability for any injury, illness, or damage incurred directly or indirectly from the use or this application of the information contained in it. It is recommended to consult with a qualified healthcare professional before implementing any suggestions or recommendations presented in this application.

Users are abundantly cautioned that scientific knowledge can be interpreted differently by different people. Science and scientific methods continuously evolve. Hence, you should verify for yourself the features provides by UP ME.

While reasonable care has been taken to ensure the accuracy of the content of the UP ME App at the time of its making, we do not warrant the accuracy, completeness, relevance or usefulness of any information provided within the UP ME app at all periods of time in the future. Therefore, any reliance placed on such information is strictly at the user's own risk, and the users are advised to exercise due diligence and consult concerned experts before using the information.

 

(iv) Translation Accuracy for Multi Lingual Function: The original content of UP ME has been created in English. However, in order to spread the benefits of the App wider, by making it readable by users not well versed with English, UP ME has been made available in several other languages, utilising third party applications and translators to convert its content into languages other than English. Users are advised that this translation process may lead to inaccuracies or alterations in the original meaning of the content of the App. While we strive for precision and clarity in all translations, the reliance on external translation tools introduces a possibility of linguistic nuances, cultural variations, or semantic shifts. Users are encouraged to be aware of these potential discrepancies and to use the translated content with discretion. The developers of this application shall not be held liable for any misunderstandings, misinterpretations, or consequences arising from the use of translated content. Users are encouraged to consult with proficient language professionals or native speakers and health professionals before using any critical or sensitive information.

By accepting these terms and conditions, the user understands and agrees that at several places in the App, the translation may not be exact or may convey a meaning different from the one in the original (English) version. By using this multi-lingual mobile application and relying on translated content, users acknowledge and accept the inherent limitations of automated translation tools and translators. Therefore, before using any version other than English, users are advised to exercise caution and discretion by getting the content compared with the English version and with concerned experts. UP ME encourages users to report to it, any identified translation discrepancies to improve the overall quality of language localization.

This disclaimer serves as a notice to users, emphasising the importance of exercising caution and cross-referencing information when utilising the application in languages other than English.

 

(v) User Responsibility:

Users are solely responsible for their interactions and activities within UPME app. We disclaim any responsibility for the conduct of users or the content they generate through their use.

 

(vi). No Endorsement:

The inclusion of any third-party links or services within the App does not imply any endorsement whatsoever. We have no control over the nature, content, and availability of those sites or services.

 

By using the app, the users agree to waive any claims against us related to the use of the application. This disclaimer is an integral part of the terms of use.

 

 

8. Governing Law and Jurisdiction

 

This Agreement is an electronic record in terms of Information Technology Act, 2000 and generated by a computer system and does not require any physical or digital signatures. 

 

These Terms are governed by and construed in accordance with the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts of Jamnagar (Gujarat, India).
